1. Acceptance of these terms

These Terms & Conditions ("Terms") are a legal agreement between you and My Fluent Reader ("My Fluent Reader", "we", "us"). By creating an account or using our website or apps (the "Service"), you agree to these Terms and to our Privacy & Safety Policy. If you do not agree, please do not use the Service.

2. Who may use My Fluent Reader

You must be at least 18 years old to create an account. My Fluent Reader is intended for children, but accounts are created and controlled by an adult — a parent, legal guardian, or an authorized teacher or school official. By adding a child reader, you confirm you have the authority to do so and to consent to their use of the Service. Children may use the Service only under the supervision of the responsible adult.

3. The Service

My Fluent Reader helps early readers build reading fluency by reading aloud with guidance, feedback, and progress tracking. We may add, change, or remove features, stories, and content from time to time to improve the Service.

4. Accounts & your responsibilities

5. Subscriptions, billing & refunds

Some content is free. Full access is offered through a paid subscription, purchased on our website and processed by Stripe, our payment processor. We never receive or store your full card number.

6. Acceptable use

You agree not to: use the Service for any unlawful purpose; copy, resell, or redistribute the Service or its content; reverse-engineer or interfere with the Service or its security; attempt to access accounts or data that are not yours; or upload content that is unlawful, harmful, or infringes others' rights.

7. Content & intellectual property

The Service, including its software, stories, characters, artwork, and other content, is owned by My Fluent Reader or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your family or classroom.

Your recordings remain yours. You grant My Fluent Reader a limited license to store and process your readers' recordings and activity solely to provide and improve the Service as described in our Privacy & Safety Policy. You can delete this content at any time.

8. Privacy

Our Privacy & Safety Policy explains how we handle information, including children's information and voice recordings. It is part of these Terms.

9. Disclaimers

The Service is provided "as is" and "as available." My Fluent Reader is an educational tool to support reading practice; it is not a substitute for professional instruction or diagnosis, and we do not guarantee particular learning outcomes. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, My Fluent Reader and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim, or USD $100 if you paid nothing. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless My Fluent Reader and its owners from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

13. Governing law & disputes

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New Jersey will have jurisdiction over any dispute, except where applicable law gives you the right to bring a claim elsewhere. We encourage you to contact us first so we can try to resolve any concern informally.

14. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify the account holder. Continued use of the Service after an update means you accept the revised Terms.
